Motion to Dismiss Penal Code 1382 & 1385

In California criminal court proceedings, the California Penal Code provides a statutory basis for motions to dismiss to be entered into the record in the criminal court proceedings. If a motion to dismiss is granted in the California criminal court proceedings the criminal defendant is thereby released from criminal prosecution pursuant to California criminal law. Pursuant to California Penal Code section 1382. (a) The court, unless good cause to the contrary is shown, shall order the action to be dismissed in the following cases: (1) When a person has been held to answer for a public offense and an information is not filed against that person within 15 days. (2) In a felony case, when a defendant is not brought to trial within 60 days of the defendant's arraignment on an indictment or information, * * *. (A) The defendant enters a general waiver of the 60-day trial requirement. A general waiver of the 60-day trial requirement entitles the superior court to set or continue a trial date without the sanction of dismissal should the case fail to proceed on the date set for trial. If the defendant, after proper notice to all parties, later withdraws, in open court, his or her waiver in the superior court, the defendant shall be brought to trial within 60 days of the date of that withdrawal. Upon the withdrawal of a general time waiver in open court, a trial date shall be set and all parties shall be properly notified of that date. * * *.

1385. (a) The judge or magistrate may, either of his or her own motion or upon the application of the prosecuting attorney, and in furtherance of justice, order an action to be dismissed. The reasons for the dismissal must be set forth in an order entered upon the minutes. No dismissal shall be made for any cause which would be ground of demurrer to the accusatory pleading. * * *
