The standard of prove in these types of civil litgation generally speaking would be by a perponderance of the evidence. Contrast this with a criminal law litigation wherein the state would be required to prove their case beyond a reasonable doubt. Although the standards of proof are different in these examples, they are are all litgations in that they seek to assert a right or claim through the courts in a case or controversy.
