How Do I Prepare for a Divorce?
If you are planning on getting a divorce, there are several things you can do in preparation of the divorce in additon to hiring a lawyer.
First you should keep a journal. This helps document your situation and appreciably assists in the preparation of your case.
Next, close, monitor and/or freeze joint accounts or lines of credit secured by any property that the community may have an interest. You and your spouse may want to divide all accounts equally or on an equitable pro rata basis, depending on your particular circumstances. What ever you agree to with your spouse, you should put it in writing.
You should also itemize your assets and liabilities as well as collect your financial information and documents, including tax returns for the last few years, bank account information, business ledgers, accounting ledgers, stock accounts, mutual funds, 401K’s, retirement accounts, trust documents, and any additional relevant financial accounts and/or documents applicable to your situation.
In addition, you want to monitor all monies spent or debts incurred or paid (major purchases, credit card payments, mortgage payments, car payments, loan payments, lines of credit extended and/or paid, etc.) once you decide to separate from your spouse. This will help ensure a proper accounting of the community assets and liabilities. Finally, you should keep a ledger and accounting of all money that you give to your spouse as spousal support (alimony), child support, or spend on their behalves. Always write checks as opposed to giving cash. It can be very hard to prove that you paid cash and checks keep a good record of the financial payments.
These are some basic preparations which significantly help to advocate your interests in your divorce proceeding.
