Orange County Litigation Attorney Working for You!

What is a Litigation Attorney?

Generally speaking litigation is the process of bringing or contesting a lawsuit. The lawsuit could be in the civil courts, criminal proceedings, or even in family law courts. Litigation is the process where a case or controversy, is decided through an adversarial court process. Our Orange County litigator litigates in the areas of civil litigation and criminal litigation. Generally speaking in a litigation the participants to the litigation want to enforce or defend a legal right or claim in the judicial proceeding.

The parties to the litigation are called litigants and are usually refered to as Plaintiff or Defendant and/or Petitioner or Respondent. In the litigation one party usually has the burden of proof to prove their case by a standard of proof determined by the nature of the judicial proceeding. For example in a civil proceeding, a plaintiff may want to enforce a civil liability on the defendant to pay for damages that he may have sustained from a torious act, or a contractual obligation, or property claim. The standard of prove in these types of civil litgation generally speaking would be by a perponderance of the evidence. Contrast this with a criminal law litigation wherein the state would be required to prove their case beyond a reasonable doubt. Although the standards of proof are different in these examples, they are are all litgations in that they seek to assert a right or claim through the courts in a case or controversy. The litigants if unable to resolve their differences among themselves then may seek a litigation attorney to bring their case to court in order to assert or defend their legal rights or claims. The lawyer in our Orange County office has experience with litigation including family law, divorce litigation, probate litigation, business litigation, criminal defense litigation and civil actions on both plaintiff and defense including tort law, business law, contract law, and real property litigation and law.
